Free movement of persons and workers in the EU and their correlation Abstract This thesis is focused on one of the fundamental freedoms of the internal market. This is the free movement of persons and workers, which define the fundamental right of every citizen of the European Union. The thesis focuses on the free movement of persons and workers from the point of view of theory and practice, with emphasis on the case law of the Court of Justice of the European Union. The subject of the thesis is to map the issue of free movement of persons and workers from the evolution of this freedom, the introduction of citizenship of the EU and the consolidating Directive 2004/38, the definition of worker, to the current situation in the light of covid-19 crisis, that had a huge impact on the freedom of movement. The aim of the thesis is to look at the free movement of persons and workers from the point of view of their correlation and compare their rights. The thesis is divided into 4 chapters, where the first chapter is focused on the historical development of freedom of movement of persons and includes a subchapter dealing with citizenship of the EU. The Employment of the Czech citizens in other member states of the European Union The basic aim of my thesis is to analyze possibilities of Czech citizens seeking job in other member states of European Union. The enlargement of EU in 2004 and 2007 opened borders to labour markets of the old EU countries for citizens of new member states. Czech citizens are able to search for a job in most of the states of EU except of Germany and Austria. In my work I concentrate especially on research of United Kingdom. It is a country that opened the labour market for Czech citizens the day our accession to European Union. My thesis is divided into seven chapters. In the first three chapters I analyze the right of free movement of persons, workers and right of settlement. I concentrate on the development from the historical point of view. I also mention the European legislation related to the free movement right. The fourth chapter explains the migration, and the potential of Czech migrant workers. Labour force mobility of citizens of the Czech republic within the countries of the European Union in 2016

The bachelor thesis provides a comprehensive insight into the issue of mobility of Czech citizens within the European Union. The theoretical part deals with basic theoretical approaches to migration, the brief development of the European Union's common migration policy and employment policy, including the current instruments supporting labour migration and the legal definition of free movement of workers. The practical part contains statistical data and results of the research, of which primary objective is to find out the current approach of Czech citizens to the possibility of working abroad. Primarily, it reveals and explains the main motivational factors and, on the other hand, the most significant obstacles for Czech citizens to make a decision to leave their homeland for work in foreign countries, including factors that have a significant influence on their motivation or obstacles.
The Concept of Worker in the European Law

The author in its Dissertation thesis deals with the concept of worker under the free movement rights in EU law. Following the introduction, the thesis itself focuses on the positive and negative delimitation of the concept. One of the core chapters of the "positive part" tries to find an answer on the research question whether any "Keck-like" principle exists as a criterion for defining obstacles to the free movement of workers. The aim of the chapter is to find an answer what shall be subsumed under the obstacles to free movement of workers and what are Member States left with to regulate freely on their territories. In regard with the negative delimitation of the concept, the author deals with the diversion between workers and non-economically active citizens of the EU. The core chapter deals with the growing tendency of Union citizens to move to the host Member States to study while retaining the status of a worker.

The Limitation of Entering the French Labour Market for Czech Citizens

This thesis focuses on a broad issue of labour migration from the view of the European Union where the subject is treated by the right of free movement of workers. This study is mostly oriented on the impact of entering the Czech Republic into European Union on Czech workers and therefore their right of free movement in labour market of every member state. The main aim of this thesis is to follow the reaction of France to enlargement of the European Union in area of free movement of workers, evaluate the sens of the transition period established for new members and to note the progressional opening of the French labour market for these states. The goal of the study is to evaluate this opening of French labour market for Czech workers.
Hindrances to Free Movement of Workers in European Court of Justice Cases

The aim of my thesis is to acquaint the reader with the problematic of free movement of workers, both from the theoretical point of view and from practical point of view based on the European Court of Justice cases. In the theoretical part of the thesis, I focus on the characteristics of internal market and definition of free movement of persons and workers. I mention individual law regulations that significantly influence the problematic of free movement of persons. Further, I describe different exceptions from free movement of workers, mutual recognition of academic qualifications and social security regarding the movement of workers. And at last in my practical part, I analyze individual cases of ECJ which have had the most significant impact on the development of free movement of workers.
Migration of labour force in the context of an enlarged Europe

My thesis deals with intra-EU migration, its motivation factors and then compares the advantages and disadvantages of migration. Free movement of workers is discussed in the next chapter as well as the key mobility drivers and its barriers. The thesis further deals with division of EU member states into receiving and sending countries. Future mobility intentions are analyzed in order to forecast the most probable moves in the future. In its last chapter it mentions labour mobility and ways how to measure it and then it analyses voluntary and forced mobility. In the following part labour mobility is compared to geographical mobility to see their practical implications. The eastern enlargement of the EU has brought some doubts about a massive inflow of labour migrants from the CEE countries to the old member states which has led to the introduction of transitional measures limiting free access to their labour markets. Therefore the main purpose of the thesis is to confirm or refuse the old member states' arguments that a potential migration from the new member states would threaten their labour markets.
Restrictions of the free movement of workers on the basis of judgments of the Court of Justice

Freedom of movement of workers constitutes right of citizens of the Union to move and reside freely within the territory of Member States for the purpose of employment. But this right is not an absolute one. Bachelor thesis focuses on restrictions which arise out of EC Treaty, such as limitations justified on grounds of public policy, public security and public health or employment in the public service. Other limitations arise out of the disunity of national provisions. In order to reduce such limitations the Council shall adopt provisions for the harmonisation of legislation. It is typical in the process of recognition of diplomas and qualifications. Main legal sources of the bachelor thesis are judgments of the Court of Justice.
Hindrances to Free Movement of Workers in European Court of Justice Cases

The aim of my master thesis is to analyze hindrances to free movement of workers both from the theoretical point of view and in relation to the European Court of Justice cases. In the first part of the thesis I summarize the development of European integration and general principles of free movement of persons. Then the attention is paid to free movement of workers itself. The definition of a worker, primary and secondary legislation governing free movement of workers and the scope of free movement of workers are presented as well. Moreover, derogations from the principle of free movement of workers are discussed. The next part of the thesis is dedicated to the description of the European Court of Justice, its composition and various types of proceedings. In the last part of the thesis the most significant ECJ cases concerning hindrances to free movement of workers are selected and analyzed.
